TERMS AND CONDITIONS

LIABILITY CLAUSE Argonaut Expeditions and its agents act only as agents for passengers in all matters pertaining to transportation, accommodations, or other services not directly provided by Argonaut Expeditions. As agents, all tickets, exchange orders, or vouchers issued by them are subject to the terms and conditions under which such means of transportation, accommodations, or other services are offered or provided. The booking agent, airlines involved, and general agent will not be liable for any vehicle furnished by any other party, firm, or corporation in carrying out or failing to carry out arrangements previously agreed upon, nor for the negligent misconduct of any such other party, firm, or corporation in providing or failing to provide services. Passengers acknowledge that the passenger contract in use by the airlines concerned, when issued, shall constitute the sole contract between the booking agent, airline, general agent, and the purchaser of these services.

TERMS AND CONDITIONS

  1. The carrier's obligations to passengers are regulated solely by the terms and conditions of this ticket. Passage on carrier vessels is granted solely under these terms and conditions. All rights, exemptions from liability, defenses, and immunities of the carrier under this contract extend to the carrier's servants, agents, and independent contractors.

  2. Acceptance of passage on the vessels by the passenger binds the passenger to all terms and conditions of this ticket.

  3. If this ticket contract is bought in the name of a third person as a beneficiary, that person is also bound by all clauses and conditions contained in this contract.

  4. This ticket contract is non-transferable. Possession of this ticket contract is required for transportation.

  5. If the passenger does not use this ticket on the specified date and vessel, except in cases where the fault lies with the carrier, the passenger forfeits all rights to future claims. If the ticket is lost, stolen, or destroyed, it will be considered void and without value.

  6. If a ship cannot sail due to force majeure or unforeseen events, resulting in the cancellation of the entire cruise, the ticket amount will be reimbursed, excluding agent commissions and incurred expenses.

  7. The carrier is not liable for delays or inability to perform this contract due to strikes, mechanical breakdowns, fire, collisions, war, riots, civil unrest, supply shortages, weather conditions, compliance with distress calls, or any action necessary to save lives at sea. The carrier reserves the right to modify itineraries due to such circumstances.

  8. The carrier may substitute the vessel named on this ticket with another vessel, whether owned by the carrier or not, without affecting the terms and conditions of this contract.

  9. The carrier does not accept liability for passengers or their baggage while using conveyances other than the vessel, including tenders.

  10. It is prohibited to carry explosives, flammable materials, or dangerous objects. Weapons are not allowed unless surrendered to the ship’s Captain.

  11. The carrier is not responsible for the loss of money, jewelry, or other valuables unless deposited with the ship's Manager for safekeeping, in which case a receipt will be provided.

  12. The carrier’s liability for lost or damaged luggage is limited to US$100 unless insured separately by the passenger.

  13. Passengers use onboard services such as medical care, barbers, hairdressers, or recreational equipment at their own risk.

  14. Participation in shore excursions, snorkeling, kayaking, or other activities is at the passenger’s sole risk. The carrier is not liable for injuries, accidents, or damages incurred during such activities.

  15. The carrier is not liable for passenger accidents unless proven to be caused by the carrier's negligence.

LIABILITY OF THE CARRIER Passengers acknowledge that expedition travel carries inherent risks, including but not limited to ship collisions, foodborne illnesses, weather conditions, civil unrest, mechanical failures, and overexertion. Full medical facilities may not be available onboard or at ports of call. By accepting these terms, passengers release the carrier from liability for personal injuries, illness, death, or property loss, except in cases of proven sole negligence by the carrier.

a. The carrier is not liable for consequential or indirect damages or for delays, regardless of cause. b. The carrier’s liability is restricted to the period in which the passenger and/or luggage is on the vessel. Other transportation and associated services are used at the passenger’s risk. c. Passengers must comply with orders and safety measures given by the ship’s Captain or designated representatives. d. Passengers with physical or mental conditions that may endanger themselves or others may be denied boarding at the Captain’s discretion. e. Minors are accepted onboard only under the full responsibility of their accompanying guardian(s). f. Claims against the carrier must be submitted in writing within 14 days of the voyage’s termination, with legal action initiated within one year of the incident.

JURISDICTION All disputes under this ticket shall be decided exclusively by the courts of Quito, Ecuador, under Ecuadorian law, to the exclusion of any other jurisdiction or legal framework.

The term “carrier” includes the ship’s owning company, managing company, owner, manager, and charterer. The term “vessel” refers to the vessel named on this ticket or any substituted vessel. The term “passenger” includes all individuals traveling under this ticket.
